Returns Policy

 

A prerequisite for returning products is to have the relevant purchase document proving the transaction (e.g., Retail Receipt, Sales Invoice/Shipment Note, etc.), as well as to contact our call center at 2310 31 3206 before proceeding to return the product.

1) Defective Products / Wrong Products

In case of a defective product, please contact our store by calling 2310 31 3206 to find out how to replace the product, provided that the legal requirements are met and the terms of our pharmacy’s return policy are respected.

Below are the terms and conditions and ways of returning non-defective products in cases where an error has been made by us:

The date of receipt of the order with the date of submission of the request for return must not exceed 7 days.
The request must be made in writing by e-mail to info@modesxristina.gr indicating relevant details and telephone number so that one of our executives can contact the customer for clarification.
The product must not have been opened or used and must be in the original (factory) condition in which it was delivered to you and included in its original packaging. Once received, its condition will be checked and if it does not meet the above conditions, the return will not be accepted. The final decision on the condition of the product rests with us.
In any case, the product to be returned must be accompanied by the corresponding sales document.

Note: In case of return of products at the request of the customer and provided that the above conditions are met, the customer shall bear the transport costs exclusively.

2) Right of Withdrawal

Unless the exceptions listed below apply (see F.), the consumer has a period of 14 calendar days to withdraw from the distance or off-premises contract without stating the reasons and without any charge beyond those provided for (see below, under C and D).
Without prejudice to Article 3f, the withdrawal period provided for in paragraph 1 of this Article shall expire 14 calendar days, for sales contracts, from the day on which the consumer or a third party indicated by him, other than the carrier, acquires physical possession of the goods or:
(i) from the day on which the consumer or a third party designated by him, other than the carrier, takes physical possession of the last good, in the case of several goods ordered by the consumer in one order and delivered separately,
(ii) from the day on which the consumer or a third party indicated by him, other than the carrier, takes physical possession of the last lot or piece, in the case of delivery of goods consisting of several lots or pieces,

(iii) from the day on which the consumer or a third party designated by him, other than the carrier, takes physical possession of the first good, in the case of a contract for the regular delivery of goods over a fixed period of time.

The parties may, if they so wish, perform their contractual obligations during the withdrawal period.

Α. Exercise of the right of withdrawal

Before the expiry of the withdrawal period, in order to exercise the right of withdrawal, the consumer must inform our company based in THESSALONIKI (email: info@modesxristina.gr ) of his decision to withdraw from this contract. To this end, the consumer may:

a) either use the model withdrawal form,

(b) or make any other clear statement showing his/her decision to withdraw from the contract (e.g. a letter to be sent by e-mail),

The consumer has exercised the right of withdrawal within the time limit referred to above if the notice of exercise of the right of withdrawal is sent by the consumer before the expiry of the time limit. The goods purchased must be returned in their original condition accompanied by the relevant sales document (receipt – invoice).
The consumer bears the burden of proving that he has exercised his right of withdrawal under this Article.

If the purchase was made by credit/debit card, the transaction will be cancelled and the consumer’s account will be updated (credited) accordingly within 30 calendar days.

Β. Effects of withdrawal

The exercise of the right of withdrawal terminates the obligations of the parties:

(a) to perform the distance or off-premises contract; or

(b) to conclude the distance or off-premises contract in cases where an offer has been made by the consumer.

Γ. Obligations of the supplier in the event of withdrawal

In the event of withdrawal, the supplier shall refund any payment received from the consumer relating to the cost of the goods, excluding delivery charges or other additional charges resulting from the consumer’s choice of a delivery method or a payment method (cash on delivery) with additional charges, without undue delay and in any event within 30 calendar days of the day on which the supplier was informed of the consumer’s decision to withdraw from the contract.
The supplier shall make the refund referred to in the first subparagraph using the same means of payment as those used by the consumer for the original transaction, unless the consumer has expressly agreed otherwise and on condition that the consumer is not charged any costs resulting from the refund.
In cases of cash on delivery, you must indicate the account to which you want the amount to be deposited.
Unless the supplier has offered to collect the goods himself, in respect of sales contracts, the supplier may withhold the refund until he has received the goods back or until the consumer provides evidence that he has sent back the goods, whichever occurs first.

Δ . Obligations of the consumer in the event of withdrawal

Unless the supplier has offered to take delivery of the goods himself, the consumer must return the goods or transfer them to the supplier or to a person authorised by the supplier to take delivery of the goods without undue delay and in any event within 14 calendar days of the day on which the consumer notified the supplier of his decision to withdraw from the contract. The deadline is met if the consumer sends back the goods before the expiry of the 14 calendar day period.

The consumer bears the direct cost of returning the goods. The consumer is only liable for any reduction in the value of the goods resulting from handling that was not necessary to determine the nature, characteristics and function of the goods (The handling and examination of the goods must be carried out in the way you would be allowed to carry out in a physical shop).

Ε. Consequences of exercising the right of withdrawal in connected contracts

Without prejudice to Article 15 of Joint Ministerial Decision Z1-699/2010 (B΄ 917) “For the adaptation of Greek legislation to Directive 2008/48/EC of the European Parliament and of the Council of 23 April 2008 on consumer credit agreements and the repeal of Council Directive 87/102/EEC”, if the consumer exercises his right of withdrawal from a distance or off-premises contract in accordance with the above, any linked contracts shall automatically terminate, at no cost to the consumer, except as provided for in

Ζ. Failure to inform about the right of withdrawal

If the supplier has not provided the consumer with the information on the right of withdrawal as required, the withdrawal period expires 12 months after the end of the initial withdrawal period as specified above.
If the supplier has provided the consumer with the information provided for above, the withdrawal period shall expire 14 calendar days from the day the consumer receives that information.

Procedure & Ways of Returning Products

At our physical store:

You may visit our store where our staff will check the condition of the product and assist you immediately. If you wish to replace the product or exchange the product with another one, it is recommended that you contact our store beforehand at 2310 31 3206 to confirm the availability of the new product.

Product dispatch:

You can send us the product by following the following procedure:

First you pack the products in the box in which you received your order. Inside the package you place the completed withdrawal form and finally you send the parcel to the Returns Department.

Cancellation of orders

Once you have registered your order on our website or placed your order by telephone, it is possible to cancel it (orders that are in the “Pending” or “In process” or “In progress” stage)

a) with a subsequent e-mail to info@modesxristina.gr , if it is sent and received by evaspharmacy.gr

b) by informing our call center, at tel. 2310 31 3206, if the products have NOT been delivered for shipment

In any other case you can cancel your order by phone at tel. 2310 31 3206, by e-mail at info@modesxristina.gr or by visiting our store, if the products have NOT been delivered for shipment.

For your convenience, know your order number.

Comments

Modesxristina.gr reserves the right to remove or legally modify its returns policy by publishing the relevant new terms and conditions on its website.

In case of repeated returns by the consumer, modesxristina.gr, reserves the right to refuse to accept a product return due to abuse of the right of withdrawal or replacement of our products, even if the above terms and conditions are met (Art. 281 CC).

If the above legal procedure is not followed or the legal conditions for accepting the return of the product are not met, then it will be returned to the consumer, who will be charged with the packaging and shipping costs.
